Jones Family Attorney Files Appeal Against Federal Judge Ruling

RICHMOND, Va.WHAG has an update in the Wayne Jones shooting case, as previously reported, Jones was shot 23 times by five Martinsburg police officers on March 13, 2013.

Last year, the Jones family filed a civil lawsuit against the city of Martinsburg and the five officers involved. That case was later dismissed and now, they’re appealing.

On Friday, the Jones family attorney filed an appeal against federal judge Gina Groh’s summary judgment ruling that dismissed their lawsuit last October. They’re also appealing a previous ruling by a United States magistrate judge.

The city’s counsel will have until March 13 to respond this appeal. After that, both parties will present oral arguments before a set of judges who will decide whether the appeal moves forward.

In 2013, a Berkeley County Grand Jury didn’t indict the five officers, clearing them of all wrong doing.
