MARTINSBURG, W.Va. - A civil suit has been filed against the Cottages of Martinsburg, an apartment complex that residents are claiming was infested with bed bugs.
According to court documents, Branden Parks is suing the complex, the residential group and both the acting and regional managers.
Documents also said the complaint includes one count of breach of implied warranty of habitablity, which requires landlords to keep their property "habitable," even if the lease does specifically require them to make repairs.
There is also one count of fraudulent inducement listed, meaning Parks feels the managers persuaded her to sign a contract through deceit.
Parks has requested a jury trial, and documents state the case will be ready for trial in June of 2018.
