WINCHESTER, Va. - In Winchester Circuit Court Wednesday, there was a pre-trial motion pertaining to an internet provider's defamation law suit.
Wave2net filed a lawsuit against Winchester Wireless back in November of 2016, claiming the internet provider defamed the business on social media sites, according to court documents.
In court, the attorney defending Winchester Wireless argued that the case should be dismissed early, because Wave2Net suffered no damage to their business as a result of the online statements.
However, the judge felt otherwise, ruling that it was up for a jury to decide that issue.
"Free speech does not end when an LLC is formed. Just because you have a company doesn't mean that company doesn't have the right to free speech, and that's what this case is about -- the ability to make comparisons [and] to draw out differences," said Beau Correll, Attorney, Correll Law Firm.
The jury trial for this case is set for Nov. 2 and 3.
