UPDATE: Man receives home detention sentence for negligent manslaughter

The victim's family agreed to the sentence

HAGERSTOWN, Md. - A 49 year-old Hagerstown man received 18 months of home detention after entering an Alford plea to criminally negligent manslaughter on Wednesday.

David Garlitz was arrested after police said he struck 47 year-old Stacey Higgins as he was crossing Pennsylvania Avenue at the intersection of Showalter Road around 2 a.m. on March 10.

According to court records, both Garlitz and Higgins were legally drunk at the time of the accident. 

The trial would have come down to whether Garlitz could have avoided hitting Higgins, regardless if he was drunk. 

Higgins' family agreed to home detention after learning that Garlitz was the main caretaker for his daughter who has special needs.
